. approval of the special use district violates the conformity requirement of state law. the proposal to adopt the so-called special use district, the one parcel of land is for the express purpose which is to grant the owner an exemption from numerous zoning rules is in essence a variance. as such, the city must comply with the procedures and make the substantive findings required by state and city law for approving a variance, which this proposal fails to do. the pagoda theater site is obviously much better than the columbus avenue extraction. we have worked and supported. our neighborhood merchants and neighbors not disrupting the business community for over a year or two. we also have a strong feeling that the pagoda site's $9 million expenditure to extract tbms which have salvage value at most 4.4 to $6 million is illogical. by not even extracting the machines at the pagoda, by varying the machines as has been done in new york city, in brisbane, australia, in the tunnel in the english channel, where machines are either lowered below tunnels or shifted to the side or [speaker not u

million. and again, that will be used to fund projects on an as-needed basis and the central subway, including the central subway project. we will ask for authorization for full 250 million. and that will allow staff to manage the program, the capital program through 2019, as an as-needed basis using the short-term cash management tool. let me pause for a moment and ask if you have any questions on the purpose or approach or use of a commercial paper program. commonly understood as a line of credit. >> and if i could just clarify, it won't fund the projects per se, it will help finance projects. the projects that we have funding for, but we don't have the cash in hand yet whether it's because we're waiting for a federal grant or next year appropriation, this is really rich, you know, gap funding or bridge funding financing that will allow us to keep a project moving in advance of the actual project funds to come in. as opposed to, say, the revenue bonds which we are borrowing money in order to put projects in the ground. >> director bridges? >> i'll interrupt you for a second. i was
to pay for a third reviewer. it is very expensive, it was done by the u.s. security team and done by dbs and a whole slew of other consultants. we don't have the funding to bring in yet a third reviewer, but what we can do is we can be presented this to our funding partners and to the fra and the fta and happy to bring you any comments that they may have. we have many third party reviewers looking at this at the request of the fire department for example. as the director mentioned we brought this number down and just to give you a perspective. we were upwards in security and other costs and we are down to 164.5. and the rva item is down from 64 million to 56 million that is what the recommendation of going to a metal skin. we went from the gt ceiling making it metal ceiling making it safer and we recommend going to a glass skin to a metal skin which will be lovely as well and we will show you the rendering. we have just about cut as much as we could possibly cut but do think that it is important to present the information that kim requested and we will do that at the next meeting. we are

use and rezonings. that didn't prove to be economically feasible. silver leathers came before the commission. however, this is the first one by mr. campos, my client, and i was at the commission in 2009 when you approved this 6 to 1 with dozens of community members supporting it in 2009. unfortunately, as you know in that period, the econ kind of fell apart and financing and so did equity. and when you approved, it was not a good time to get financing and start construction. * economy now the aloe am -- economy has come back, lending is available. the client is ready to go forward and start with all the final permitting when the city claim to the client a few months ago and asked that his construction be delayed by reason of using the site for up to two years for removing the boring equipment. and since then my client has agreed to delay his construction. and there are some risks. however, it seems like it's what's best for the city and the neighborhood, and was willing to come back before you and is today on essentially the same project. but instead of a demolition -- excus
to the tjpa. so in summary, the sfpuc is offering us an ongoing service rate that would be 10% lower than pg&e's. an initial cost of connection that is again roughly $650,000 less than pg&e's. and has a comparable level of reliability of service. and so the recommendation is that the board authorize staff to negotiate an agreement with puc. >> thank you. actually i did have a quick question. i wasn't clear from the summary, the $661,000 of the itcc, are we going to discount that amount to the puc? because in the summary it said a minus and i wasn't sure we would offer that credit to the puc, since we would not have to pay it to pg&e. >> the puc has said is that they would limit the cost to the tjpa to the amount that it would cost them to establish pg&e network grid service, less the amount of that fee. so that is a further decrease in the initial cost investment to the tjpa for the amount of that fee, which at the time of the pg&e proposal was 22% of the costs. >> thank you. director metcalf? >> why is the sf puc proposing to subsidize the installation by 3. 5 million dollars? >> the

. it was impressive the level of data they have and how they're able to use it to try and increase safety on the buses. so, i'm wondering do we have or will we be getting that same level of data for bike and pedestrian safety? i know it's not as easy to gather since i think a lot of those muni calls either involve the police or are 311 calls. but it would be interesting to know if that same level of data exists for bike and ped because it can help in our safety quest. >> we can ask [speaker not understood] reiskin. >> one other item. i feel that from our day long strategy meeting that we may have left some sort of hanging unanswered questions from staff, particularly on the bicycle strategy where on the last page we were asked if we wanted to ask staff to focus on hot spots or corridors. and we don't -- obviously can't stay with us. discuss it today, but i wonder if we need to come back and retouch on that. * it occurred to me on this weekend when i was riding that we have a bike strategy, we have a pedestrian strategy, but we don't really have a corridor strategy yet, which i know will evolve out of
the contingentcies and reserves that will allow us to complete the delivery of the phase one program. and so, within the budget today. there are a number of components of contingentcies and reserves within the budget and the first is the design contingentcy. >> it is embedded within the construction costs budgets and it represents a reserve for unknowns in the design at any status and any point in the design process. so that the typical expectation is that as you move through the design process, those design contingentcies, are reduced to 0. but at the same time, additional detail comes in to the design and is reflected in the design documents that off-sets that contingentcy. our contingentcies are not currently at 0 as we have not completed the design. but, we are carrying roughly $8 million in the design contingentcy bucket at this point. the second category again is within the construction budget is the construction contingentcy and that is a reserve that is held for the course of construction, unforeseen conditions and other change ts in the scope or construction requirements. and the reserve, a

, the conditional use applications, the amendments to the zoning, zoning map, bulk, height, and although issues. i have a package which i will submit at the end of my testimony which elaborates those issues. i will try to paraphrase the key issues. one, a subsequent or supplemental e-i-r is required to access the environmental impacts of altering the alignment and terminus of the subway tunnels north of chinatown station. to change the tpm extraction location from columbus avenue to pagoda theater parcel. included in this package is a [speaker not understood] and geotechnical report, a letter from the various teams, geotechnical [speaker not understood] larry carp. there are issues also which include issues of dewatering and impacts on very fragile adjacent buildings. two, the subsequent and supplemental e-i-r is required to assess the impact thev historic resources which were not included in the previous e-i-r or the current evaluations. and finally, three, the subsequent supplemental [speaker not understood] to assess the environmental impacts of expanding central subway service north beach. so,
